<p>Jeff Langley, the Enotah Circuit District Attorney, is no longer permitted
 to prosecute Jonathon Morgan due to a breach of client-attorney confidentiality.
 Jonathon Morgan, a client of Attorney Andrew Richman, faces a 21-count
 indictment including charges of rape, aggravated sodomy, and aggravated
 child molestation. Morgan requested a review from the Department of Behavioral
 Health and Developmental Disabilities following the charges, but this
 report somehow ended up in the hands of a staff prosecutor.</p>



<p>The confidential competency report was going to be used to attest to Jonathon
 Morgan’s ability to stand trial, but after the evaluation was complete
 it was shared with the wrong authorities. The psychological report was
 mistakenly sent to the office of Jeff Langley, where the email was subsequently
 opened by a staff prosecutor. The woman who received the email says she
 opened it and “glanced” at it. However, Attorney Richman argued
 that this simply wasn’t fair.</p>



<p>According to Attorney Richman, due to attorney-client privilege, the prosecutor
 was simply not permitted to read the health report. By opening the psychological
 evaluation the office should be disqualified from prosecuting Morgan’s
 case. To do so, Attorney Richman filed a motion to have the DA taken from
 the case, which was set for trial next month.</p>



<p>Attorney Richman argued, very simply, “my client’s future is
 on the line, and I will do everything within the rules of ethics to ensure
 his rights are protected.”</p>

<p>In a case which has just recently come to a close, a Richman Law Firm client
 was acquitted of all felony charges of impersonating a police officer.
 This case was a highly satisfying victory for our Cumming criminal defense
 attorney, AJ Richman, as our own investigation revealed that our client
 was completely innocent. As a government employee, our client’s job
 and future were at risk in this case.</p>



<h2 class="wp-block-heading" id="h-the-initial-incident">The Initial Incident</h2>



<p>In August of 2014, our client Sonya A. had visited Austin’s Tavern
 in Cumming, and had allegedly flashed a badge when asked to present her
 ID, claiming that she was a police officer. At that point, bar management
 called the police, and Sonya was led away in handcuffs.</p>



<p>Upon taking Sonya’s case, however, it quickly became clear that there
 were serious holes in the stories told by the bar’s staff. We launched
 our own investigation into the case, and quickly determined that the lack
 of an initial investigation by arresting officers was just one of several
 issues with the prosecution’s case. When we presented our case in
 court, justice prevailed.</p>

 At the end of August, the State Bar of Georgia will host the 5<sup>th</sup> Annual DUI Training Super Symposium, the largest
 <a href="/dui-defense/">DUI</a> seminar in the state. I am proud to announce that I have been selected
 to teach at this event. The training will take place over three days,
 from August 26<sup>th</sup> through the 28<sup>th</sup>.
 </p>
 <p>I was selected to speak at this seminar due to my reputation as one of
 Georgia’s top criminal defense lawyers. It’s quite an honor
 to be chosen to teach one’s peers, and it speaks to my years of
 legal experience and record of successful results. I will be speaking
 on the topic “Presenting Evidence of Sobriety at Trial,” a
 critical component of a DUI defense. Essentially, I will be teaching attorneys
 how to use evidence of impairment to actually prove sobriety.</p>
 <h2 class="wp-block-heading">Continuing Legal Education</h2>
 <p>In the State of Georgia, all active lawyers are required to complete at
 least 12 hours of continuing legal education each year. These courses

<p>Its official — after a vote on Thursday, July 2, Dawson County adults
 can now be fined for knowingly hosting underage drinkers. This makes Dawson
 County the second in the state with such an ordinance, following the actions
 of Cobb County. Only one member of the Dawson County Board of Commissioners,
 Jimmy Hamby, voted against the new ordinance, claiming that responsibility
 lies with “the young people who are drinking” and adding that
 “parents are not responsible for everything.”</p>



<p>However, the other three Commissioners disagreed, and passed the ordinance
 3-1. The predominant feeling was perhaps best summed up by “Be the
 Key” coordinator Tiffany Davis, who stated that the ordinance “is
 about holding adults liable if they make a damaging decision for another
 parent’s child.” This sentiment was echoed by Family Connection
 coordinator Nancy Stites and Dawson County Sherriff Billy Carlisle in
 their statements before the board. This ordinance will not apply to parents
 who allow their own children to drink alcohol.</p>



<p><strong>Under this new ordinance, adults can be subjected to penalties including:</strong></p>



<ul class="wp-block-list">
<li>First offense — up to $1000 fine</li>



<li>Second offense — minimum $500 fine</li>



<li>Third offense — minimum $1000 fine</li>
</ul>



<p>Prior to the hearings, the main arguments against the ordinance were centered
 on private property rights. However, no one spoke in opposition of the
 ordinance during the first of the public hearings.</p>



<p>
 Naturally, this ordinance raises some serious legal questions. Can a parent
 be held responsible if they aren’t present at the time? How enforceable
 is this? What evidence is required for a
 <a href="/criminal-defense/">conviction</a>?
 </p>
